of a disturbing crime. nathan portnoy is the soldier in the virginia national guard recently recognized for his heroic actions during the summer's derecho storm. fox 5's laura evans has the top story tonight. >> this was the same guy who made news on june 29th during the derecho for performing cpr on a man in falls church hit by electric wires that came down in the storm. many called him a hero. now prosecutors argue he's a sexual predator, but today his defense attorney insisted the prosecutors got it wrong. it was around dinner time august 24th. police say nathan portnoy kidnapped a 12-year-old girl outside her bethesda neighborhood. according to court document, portnoy pointed a gun at the girl's sister and boyfriend chasing him. it may sound like an open and shut case, but portnoy's defense attorney says there is much more to this story. >> this is a great guy. >> reporter: portnoy was described in court as a-month- old citizen. he works as a -- model citizen. works as a lab assistant at walter reed and takes care of his mother who has cancer. at a bond hearing dozens showed up to support

in virginia causing some concern for the romney camp. form ill congressman virgil gude, jr. has qualified for the presidential ballot. he spent 12 years in congress and 4 years in the state senate serving as an independent and a republican. his them on the ballot could be an obstacle for romney. he has support from the independent green party. the state republican party is challenging his eligibility. >>> new this morning, another assault in the capitol hill neighborhood. this happened tuesday morning around 2:for on north carolina avenue. d.c. police say the victim was robbed and beaten. this happened just a few blocks away from a robbery and assault last month that left the victim critically injured. t.c.maslin was brutally beaten near eastern market as he walked home after a night out with friends. his wife is a d.c. school teacher and the two have a young son. maslin has beyond gone brain surgery and remain in the hospital. police say there is no obvious connect to the two assaults but both investigations do remain open. >>> a public memorial for american hero neil armstrong will be h

mahon, virginia senate candidate george allen, and now nevada senator dean hower have all gone wobbly, refused to stand with, stand for the outed mitt romney, the one who tells rich people that the rest of the country is a bunch of loafers, freeloaders, bums. well, last night a new wobbler showed up, mitt romney himself. racing like a desperate crazy man, he suddenly declared he's changed his mind on the whole 47% business. that he's now proud of being the grandfather of obama care, proud to say he's for same-sex couples having partner rights and no way he wants to run those 12 million immigrants out of the country. so how scared is this candidate that he's now turning tail on so much of what he's been standing for? is the man we caught behind the curtain suddenly afraid of the script he's been reading? is this the moment, the etch-a-sketch moment, we were warned was coming, the alloutmoment of moral melt down. this afternoon, this afternoon at the univision candidates forum president obama responded to romney's caught on tape comments where he wrote off 47% of the country. let's take a listen
